These Terms of Use are a binding agreement between you and Kibira Ventures LLC, an Indiana limited liability company d/b/a Indy Septic Pros (“Indy Septic Pros,” “we,” “us,” or “our”), regarding your use of indysepticpros.com and related services.
By accessing the website, submitting a request, or checking a box indicating acceptance, you agree to these Terms.
1. The Services
Indy Septic Pros is a lead-generation and referral platform. It may allow users to submit information about septic tank pumping, septic system inspection, emergency or backup septic service, or related projects and to be connected with independent businesses or individuals that may offer those services (“Service Providers”).
Indy Septic Pros may receive compensation from Service Providers for leads, calls, introductions, listings, advertising, or related opportunities.
2. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract.
If you submit a request for a business, property owner, property manager, association, or other organization, you represent that you are authorized to act for that party.
3. Marketplace Role and Independent Service Providers
Indy Septic Pros does not itself perform, supervise, direct, control, warrant, or guarantee septic tank pumping, septic system inspection, or other septic services.
Service Providers are independent third parties and are not employees, agents, representatives, partners, joint venturers, franchisees, or subcontractors of Indy Septic Pros.
Submitting a request does not create a service contract between you and Indy Septic Pros.
Any estimate, proposal, contract, deposit, payment, scheduling commitment, warranty, or other agreement for septic services is solely between you and the applicable Service Provider.
4. Project Requests
You agree that information submitted through the website will be accurate, current, and complete to the best of your knowledge.
You authorize Indy Septic Pros to review and process your request, contact you about the request, share the information you provide with one or more independent Service Providers, and permit those providers to contact you about the requested project.
Submission does not guarantee that a Service Provider will respond, provide an estimate, accept the project, offer a particular price, or complete the work.
5. No Endorsement or Guarantee
Unless expressly stated otherwise, Indy Septic Pros does not guarantee or make representations regarding a Service Provider’s:
- Licensing, county health department registration, permits, certifications, bonding, or insurance;
- Qualifications, experience, reputation, or financial condition;
- Availability, pricing, workmanship, materials, safety, or completion dates;
- Employees, subcontractors, or suppliers;
- Warranties, refunds, or dispute handling; or
- Suitability for a particular project.
You are responsible for independently evaluating each Service Provider before hiring, including verifying credentials, county registration, insurance, references, pricing, warranties, and contract terms.
6. General Educational Content Is Not Regulatory or Legal Advice
The website may include general information about septic system maintenance and Indiana septic regulation, including information about state minimum standards and the role of county health departments. This information is provided for general educational purposes only.
Septic system permitting, oversight, registration requirements for pumping companies, and maintenance rules are set and enforced at the county level in Indiana and vary by county. The website does not state, and should not be read to state, the specific requirements of any particular county.
Nothing on the website is legal, regulatory, or compliance advice, and nothing on the website constitutes a representation that any pumping interval, inspection requirement, or maintenance practice satisfies the requirements of your specific county. You are responsible for confirming applicable requirements with your county health department.
7. Customer and Service Provider Disputes
Any dispute concerning an estimate, contract, deposit, payment, scheduling issue, cancellation, property damage, personal injury, incomplete work, defective work, warranty, refund, or other matter relating to septic services must be resolved directly between the customer and the applicable Service Provider.
Indy Septic Pros is not a party to agreements between customers and Service Providers and has no obligation to investigate, mediate, resolve, defend, or pay a claim arising from those agreements or services.
Indy Septic Pros may, at its discretion, receive complaint information, request a response, assist with communication, suspend a provider, or refer a matter to appropriate authorities. Doing so does not make Indy Septic Pros responsible for the dispute.
8. Release
To the fullest extent permitted by law, you release Indy Septic Pros and its owners, officers, employees, representatives, affiliates, successors, and assigns from claims, losses, liabilities, damages, costs, and expenses arising from or relating to:
- Communications or dealings between you and a Service Provider;
- Services offered, performed, delayed, cancelled, or not performed by a Service Provider;
- Payments, deposits, refunds, estimates, contracts, warranties, or representations made by a Service Provider;
- The acts, omissions, negligence, misconduct, or legal violations of a Service Provider; and
- A Service Provider’s compliance or noncompliance with county or state septic regulations.
This release does not apply to liability that cannot lawfully be excluded or limited, or to claims arising directly from Indy Septic Pros’s own fraud, intentional misconduct, or other conduct for which liability cannot be waived.
9. Payments to Providers
Unless expressly stated otherwise, Indy Septic Pros does not collect, hold, process, direct, or guarantee customer payments to Service Providers.
Indy Septic Pros is not responsible for deposits, financing, chargebacks, refunds, payment disputes, or collection efforts arising between a customer and Service Provider.
10. Communication Consent
By submitting a request, you authorize Indy Septic Pros and the independent Service Providers selected for your request to contact you by telephone, text message, and email about that request, subject to applicable law.
Message and data rates may apply. Reply STOP to opt out of text messages.
Separate prior express written consent must be obtained when legally required for prerecorded, artificial-voice, or automatically dialed marketing calls or texts.
11. Acceptable Use
You may not:
- Submit false, misleading, fraudulent, unlawful, or unauthorized requests;
- Impersonate another person;
- Submit another person’s information without permission;
- Harass, threaten, deceive, or unlawfully solicit anyone;
- Interfere with website operation or security;
- Introduce malware or harmful code;
- Scrape or extract data without written permission;
- Bypass access controls;
- Infringe intellectual property, privacy, or other rights; or
- Violate applicable law.
12. User Content
You retain ownership of information, photographs, files, text, and other materials you submit.
You grant Indy Septic Pros a nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, format, display, and disclose submitted materials as reasonably necessary to operate the website, process your request, connect you with providers, communicate with you, prevent fraud, enforce these Terms, and comply with law.
13. Intellectual Property
The website, including its design, text, graphics, logos, software, databases, and other content, is owned by or licensed to Indy Septic Pros and protected by applicable law.
You may use the website only for lawful personal or internal business purposes.
14. Third-Party Content
The website may contain third-party content, links, reviews, advertisements, or integrations. Indy Septic Pros does not control or endorse third-party content and is not responsible for its accuracy, security, availability, or practices.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the website and related services are provided “as is” and “as available.”
Indy Septic Pros disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and results.
Indy Septic Pros does not warrant that the website will be uninterrupted, error-free, secure, or that any request will result in a response, estimate, contract, or satisfactory project, or that any educational content reflects the current or complete requirements of any particular county.
16. Limitation of Liability
To the fullest extent permitted by law, Indy Septic Pros will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, business, or goodwill; or costs of substitute services arising from the website, a referral, communications with a Service Provider, or services provided by a Service Provider.
To the fullest extent permitted by law, Indy Septic Pros’s total aggregate liability for all claims arising from the website or referral service will not exceed the greater of:
- The amount you paid directly to Indy Septic Pros during the twelve months preceding the claim; or
- One hundred U.S. dollars ($100).
This limitation does not apply where prohibited by law.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Indy Septic Pros and its owners, officers, employees, representatives, affiliates, successors, and assigns from third-party claims arising from your unlawful use of the website, your submitted content, your violation of these Terms, or your fraud, willful misconduct, or material misrepresentation.

19. Termination
We may suspend or terminate access when we reasonably believe a user has violated these Terms, created legal or security risk, or misused the website.

21. Governing Law and Venue
These Terms are governed by Indiana law, without regard to conflict-of-law principles.
Before filing a lawsuit, the parties agree to make a good-faith effort to resolve the dispute by written notice. Unless applicable law requires otherwise, any judicial proceeding must be brought in the state or federal courts located in Marion County, Indiana.
Nothing prevents an eligible party from bringing a claim in small claims court.
22. Electronic Transactions
You consent to conduct transactions electronically and agree that electronic records, check-box acceptance, and electronic signatures may satisfy legal signature and writing requirements where permitted by law.
23. Miscellaneous
These Terms and incorporated policies are the entire agreement regarding the website unless another written agreement applies.
If a provision is unenforceable, the remaining provisions will remain effective.
Indy Septic Pros’s failure to enforce a provision is not a waiver.
